生态公益林区划界定是典型的政府职权行为,而生态公益林管护属于政府采购服务。实践中所谓森林生态效益补偿,实际上主要是通过支付管护工资实施的,不符合法治要求,难以持续。应当在法律上正确区分生态效益补偿协议和生态公益林管护协议,在生态公益林建设中引入民法规则,通过立法设计生态保护地役权,将生态效益补偿协议改造为生态保护地役权合同,同时将生态公益林管护纳入政府集中采购目录,向社会购买生态公益林管护服务。

The devision of ecological public welfare forest zone is a typical government adminstration behavior, and he ecological forest management belongs to the government procurement service. Practically,the so-called com-pensation for forest ecological benefits, in fact, is mainly implemented through the payment of management and protection wages,which does not conforms to the rule of law,and is difficult to sustain.
