我国《民法典》中不可抗力的评述与适用应当分为两个层面,即不可抗力事件和不可抗力条款。不可抗力事件即《民法典》一百八十条第二款所规定的情形。不可抗力条款则是指涉及不可抗力事件的法律规则。不可抗力的认定应当严格遵循"三个不能"的原则。通过对政府行为以及新冠疫情的不可抗力分析,得出不可抗力条款实质上是冠以不可抗力名义的免责条款,不应当纳入《民法典》所规定的不可抗力范畴之内。当事人约定限缩或者扩大不可抗力范围的条款因为违反法律的强制性规定无效。

The commentary and application of force majeure in PRC Civil Code should be divided into two levels,which are the force majeure events and force majeure clauses.Force Majeure events are the situations stipulated in article 180,paragraph 2,of PRC Civil Code and force majeure clauses refer to the legal rules governing the event.The determination of force majeure should follow the principle of the“three cannot”principle strictly.Through the analysis of government behavior and the epidemic of COVID-19,it is concluded that the force majeure clause...
