通过考察我国刑法,可以发现我国刑法在规制危害矿山生产、生态安全犯罪方面存在忽视对矿山生态安全的保护、预防滞后、刑罚体系不科学等不足,应从加强对矿山生态安全的保护、增设危险犯、增加刑罚种类和非刑罚处罚措施等方面着手,加强刑法对危害矿山生产、生态安全犯罪的抗制。
