数字技术的发展加剧了数字鸿沟。普通公民在强大的数字技术面前处于弱势地位，其数据权、个人信息权以及隐私权等面临风险，亟需法治保障。通过考察域外经验可知，被遗忘权是应对这一问题的最有效手段。我国《个人信息保护法》第四十七条规定的“删除权”虽然与被遗忘权高度相似，但本质并不相同。被遗忘权可以综合衡量多方要素，能够有效尊重和保护数字化人格，充分保障数据主体的信息自决权。应当首先秉持谦抑原则和比例原则，继而结合扩大解释、正当程序、个案判定以及行业自律的基本立场，实现被遗忘权的制度构建。
