On the Improvement of Trade Secret Protection System:From the Perspective of the Amendment of Anti-Unfair Competition Law

商业秘密是企业在激烈的市场竞争中制胜的"法宝".要想保护商业秘密,需要企业自身进行制度保障,但更离不开法律保护的大环境.我国没有专门针对商业秘密保护的立法,而是分散见于不同的法律条文中,极不利于商业秘密的保护.在我国《反不正当竞争法》时隔24年后首次修订之际,认为应在《反不正当竞争法》中引入惩罚性赔偿制度,完善侵权举证责任,以更好地对商业秘密进行保护.
