A Case Study of the Legal Regulation of Face Recognition Technology Applied in Public Places

人脸识别技术作为智能社会前沿的标杆技术，其应用与规制是近年来法律研究的前沿问题。从人脸识别技术的应用场域可分为公共场所应用、私人场所应用、虚拟网络应用。公共场所应用是其中的规制重点、难点。但当前我国对公共场所应用的规制措施并不到位，对于公共场所内公共利益、群体利益、个体利益如何权衡的问题也没有定论。基于公共场所应用别于其他单一信息处理的特殊性，应当从目的、主体、手段三大要件的角度出发，用场景化的思路将公共场所分为完全应用场所、约束应用场所、禁止应用场所展开讨论。不同类型的场景模型各有侧重，取长补短实现人格利益的平衡保护。通过解构“人脸识别装置侵...
