城市房屋拆迁是一个关系到公民个人财产权利的重大问题,同时也是政府行使行政管理职权的重要体现。但现实中拆迁时各方的利益博弈却存在严重的不均衡,被拆迁人利益经常受到侵害。解决这一矛盾的根本途径在于重构我国房屋拆迁制度的立法理念;厘清政府在房屋拆迁中的职能定位,退出拆迁人和被拆迁人之间的民事关系;同时需要完善相关法律体系控制政府权利的滥用以及加强社会各界的共同参与和监督。
